Under the Digital Personal Data Protection Act, 2023 (“DPDPA”):

• Olive Digital Solutions Private Limited is the Data Fiduciary — the entity that determines the purpose and means of processing your personal data. ओलिव डिजिटल सोल्यूशंस प्राइवेट लिमिटेड डेटा फिड्यूशरी है — वह संस्था जो आपके व्यक्तिगत डेटा के प्रसंस्करण के उद्देश्य और तरीके निर्धारित करती है।

2. What is Simply Khata?

सिंपलीखाता क्या है?

Simply Khata is a digital organisation and governance platform designed for Farmer-Producer Organisations (FPOs) and their members. The app helps FPOs manage their operations, including member records, share capital, procurement, sales, financial transactions, governance activities, and compliance — all in one place.

सिंपलीखाता एक डिजिटल संगठन और शासन प्लेटफॉर्म है जो किसान उत्पादक संगठनों (FPOs) और उनके सदस्यों के लिए बनाया गया है। यह ऐप FPOs को उनके संचालन का प्रबंधन करने में मदद करता है, जिसमें सदस्य रिकॉर्ड, शेयर पूंजी, खरीद, बिक्री, वित्तीय लेन-देन, शासन गतिविधियां, और अनुपालन शामिल हैं — सब कुछ एक ही जगह पर।

3. Who can use the app

ऐप कौन उपयोग कर सकता है

You may use Simply Khata if you are at least 18 years of age and are capable of entering into a legally binding agreement under Indian law. The app is intended for use by FPO board members, management staff, accountants, and farmer-members who are authorised by their FPO to access the platform. By using the app, you represent that you meet these conditions.

4. Your account

You are responsible for keeping your phone number, login credentials, and OTP confidential. Any activity that happens through your account is your responsibility. If you believe your account has been accessed without your permission, please contact us immediately.

5. What data we collect

When you use Simply Khata, we collect the following categories of information:

As required under the DPDPA, the table below lists each category of personal data we collect, along with the specific purpose for which it is processed:

We collect only the personal data that is necessary for the purposes stated above (data minimisation). We do not collect any data beyond what is required to provide you the app’s services and to fulfil our obligations to Supporting Organisations.

5.2 FPO and business data

5.3 Technical data

6. How we use your data

We use your data for the following purposes:

7. Data storage and security

Your data is stored on secure servers located in India. We implement reasonable technical and organisational measures to protect your data from unauthorised access, loss, or misuse. However, no system is completely secure, and we cannot guarantee absolute security.

7.1 Data breach notification

In the event of a personal data breach that affects your data, we will notify the Data Protection Board of India (once constituted) and you, the affected Data Principal, without undue delay, in accordance with the DPDPA. The notification will include the nature of the breach and the steps we are taking to address it.

8. Data sharing with Supporting Organisations

This is an important section. Please read it carefully.

8.1 What is a Supporting Organisation?

सहायक संगठन क्या है?

Many Farmer Producer Organisations (FPOs) that use Simply Khata are promoted, incubated, funded, or supported by external organisations such as NGOs, producer organisation promoting institutions (POPIs), foundations, CSR programmes, government bodies (including NABARD, SFAC, and state rural livelihood missions), financial institutions, or development agencies (each, a “Supporting Organisation”).

The list of current Supporting Organisations is maintained in Schedule A attached to this agreement and may be updated from time to time.

You will be notified in advance whenever a new Supporting Organisation is added to Schedule A. This notification will be sent through the app (via a pop-up, push notification, or in-app banner) at least 15 days before the new organisation gains access to any data. The notification will clearly state the name of the organisation, the programme it is associated with, and the level of data access it will receive. If you do not wish your data to be shared with a newly added organisation, you may exercise your right to withdraw consent or delete your account as described in Sections 10 and 12.

8.2 What data may be shared

कौन-सा डेटा साझा किया जा सकता है

Depending on the agreement between the Company and each Supporting Organisation, the following types of data may be shared:

(a) Aggregated and anonymised data — Statistical summaries, trends, sector-level insights, and reports that do not identify any individual user or business. This data may be shared with any Supporting Organisation.

(b) Business-level data — Your FPO’s organisational and business data, including member records, share capital, procurement, sales, expenses, governance records, and other data as recorded in the app. This data may be shared with a Supporting Organisation only if that organisation has a specific written agreement with the Company authorising such access, and your FPO is identified as a beneficiary, participant, or member of a programme run or supported by that organisation.

(b) व्यवसाय-स्तरीय डेटा — आपके FPO का संगठनात्मक और व्यापारिक डेटा, जिसमें सदस्य रिकॉर्ड, शेयर पूंजी, खरीद, बिक्री, खर्चे, शासन रिकॉर्ड, और ऐप में दर्ज अन्य डेटा शामिल है। यह डेटा किसी सहायक संगठन के साथ केवल तभी साझा किया जा सकता है जब उस संगठन का कंपनी के साथ ऐसी पहुंच को अधिकृत करने वाला विशिष्ट लिखित समझौता हो, और आपके FPO की पहचान उस संगठन द्वारा चलाए जा रहे या समर्थित कार्यक्रम के लाभार्थी, प्रतिभागी, या सदस्य के रूप में हो।

8.3 Purpose of data sharing

डेटा साझा करने का उद्देश्य

Supporting Organisations may use shared data for purposes including but not limited to:

सहायक संगठन साझा डेटा का उपयोग निम्नलिखित उद्देश्यों के लिए कर सकते हैं, जिसमें शामिल हैं लेकिन इन्हीं तक सीमित नहीं:

• Monitoring and evaluating the progress and performance of supported FPOs समर्थित FPOs की प्रगति और प्रदर्शन की निगरानी और मूल्यांकन
• Programme design, impact assessment, and reporting to their own donors or stakeholders कार्यक्रम डिज़ाइन, प्रभाव मूल्यांकन, और अपने दाताओं या हितधारकों को रिपोर्टिंग

8.4 Your consent and right to withdraw

आपकी सहमति और वापस लेने का अधिकार

By accepting these Terms and using the app, you give your free, specific, informed, and unambiguous consent to the sharing of your data with Supporting Organisations as described in this Section 8.

इन शर्तों को स्वीकार करके और ऐप का उपयोग करके, आप इस धारा 8 में वर्णित अनुसार सहायक संगठनों के साथ अपने डेटा को साझा करने के लिए अपनी स्वतंत्र, विशिष्ट, सूचित और स्पष्ट सहमति देते हैं।

You understand and agree that:

• The Company may share your business data with the relevant Supporting Organisation(s) without requiring separate, transaction-by-transaction consent from you. कंपनी आपसे अलग से, प्रत्येक लेन-देन के लिए सहमति लिए बिना, आपके व्यापारिक डेटा को संबंधित सहायक संगठन(ओं) के साथ साझा कर सकती है।

Right to withdraw consent / सहमति वापस लेने का अधिकार: Under the DPDPA, you have the right to withdraw your consent at any time. Withdrawing consent is as easy as giving it. You may withdraw your consent for data sharing with Supporting Organisations by navigating to Settings > Data Sharing in the app, or by contacting our Grievance Officer (see Section 14). Upon withdrawal:

• You may continue to use the app for your FPO’s organisational and accounting purposes. 9. Data sharing with third parties

Apart from Supporting Organisations, we may share your data with:

1. Service providers who help us operate the app (e.g., cloud hosting, SMS services, analytics). 10. Your rights under the DPDPA

Under the Digital Personal Data Protection Act, 2023 and applicable Indian law, you have the following rights as a Data Principal:

डिजिटल व्यक्तिगत डेटा संरक्षण अधिनियम, 2023 और लागू भारतीय कानून के तहत, एक डेटा प्रिंसिपल के रूप में आपके निम्नलिखित अधिकार हैं:

1. Right to access / पहुंच का अधिकार — You may request a summary of the personal data we hold about you and information about how it has been processed. आप हमारे पास मौजूद अपने व्यक्तिगत डेटा का सारांश और इसे कैसे प्रसंस्कृत किया गया है, इसकी जानकारी मांग सकते हैं।
2. Right to correction / सुधार का अधिकार — You may request correction of inaccurate, incomplete, or misleading personal data. आप गलत, अधूरे, या भ्रामक व्यक्तिगत डेटा में सुधार का अनुरोध कर सकते हैं।
3. Right to erasure / मिटाने का अधिकार — You may request deletion of your personal data, subject to legal retention requirements. See Section 12. आप अपने व्यक्तिगत डेटा को हटाने का अनुरोध कर सकते हैं, कानूनी रूप से रखने की आवश्यकताओं के अधीन। धारा 12 देखें।
4. Right to withdraw consent / सहमति वापस लेने का अधिकार — You may withdraw your consent for data processing at any time, as described in Section 8.4. Withdrawal of consent shall be as easy as giving consent. आप धारा 8.4 में वर्णित अनुसार किसी भी समय डेटा प्रसंस्करण के लिए अपनी सहमति वापस ले सकते हैं। सहमति वापस लेना उतना ही आसान होगा जितना सहमति देना।
5. Right to nominate / नामांकन का अधिकार — You may nominate another individual to exercise your rights in the event of your death or incapacity. आप अपनी मृत्यु या अक्षमता की स्थिति में अपने अधिकारों का उपयोग करने के लिए किसी अन्य व्यक्ति को नामांकित कर सकते हैं।
6. Right to grievance redressal / शिकायत निवारण का अधिकार — You may raise a complaint with our Grievance Officer (see Section 14). If you are not satisfied with our response, you have the right to file a complaint with the Data Protection Board of India once it is constituted and operational under the DPDPA. आप हमारे शिकायत अधिकारी के पास शिकायत दर्ज कर सकते हैं (धारा 14 देखें)। यदि आप हमारी प्रतिक्रिया से संतुष्ट नहीं हैं, तो DPDPA के तहत भारत डेटा संरक्षण बोर्ड के गठित और कार्यरत होने के बाद आपको वहां शिकायत दर्ज करने का अधिकार है।

To exercise any of these rights, please contact our Grievance Officer using the details in Section 14, or use the relevant options under Settings > My Data in the app. We will respond to your request within 30 days.

11. Acceptable use

You agree not to:

• Use the app for any unlawful purpose or to record fraudulent transactions. ऐप का उपयोग किसी गैर-कानूनी उद्देश्य या धोखाधड़ी वाले लेन-देन दर्ज करने के लिए।

12. Account deletion and data retention

खाता हटाना और डेटा प्रतिधारण

You may request deletion of your account at any time by contacting us at the details in Section 14, or through Settings > My Account > Delete Account in the app.

Note / ध्यान दें: If you only wish to stop data sharing with Supporting Organisations but want to continue using the app, you do not need to delete your account. You may withdraw data-sharing consent separately as described in Section 8.4.

Upon account deletion:

13. Changes to this agreement

We may update these Terms and Privacy Policy from time to time. When we make material changes, we will notify you through the app (via a pop-up, notification, or in-app banner) before the changes take effect. Your continued use of the app after such notification constitutes acceptance of the updated terms.

The Grievance Officer shall acknowledge your complaint within 48 hours and resolve it within 30 days.

15. Governing law and disputes

This agreement is governed by the laws of India. Any disputes arising from or related to this agreement shall be subject to the exclusive jurisdiction of the courts in India as specified in our published contact / incorporation details.

यह समझौता भारत के कानूनों द्वारा शासित है। इस समझौते से उत्पन्न या संबंधित विवाद हमारे प्रकाशित संपर्क / निगमन विवरण में निर्दिष्ट भारत की अदालतों के विशेष अधिकार क्षेत्र के अधीन होंगे।

16. Limitation of liability

Simply Khata is provided “as is.” While we strive to keep the app reliable and accurate, we do not guarantee that it will be error-free, uninterrupted, or suitable for any specific purpose. The app is an organisation and governance tool and is not a substitute for professional accounting, legal, or tax advice.

सिंपलीखाता “जैसा है” के आधार पर प्रदान किया जाता है। हम ऐप को विश्वसनीय और सटीक रखने का प्रयास करते हैं, लेकिन हम गारंटी नहीं देते कि यह त्रुटि-मुक्त, निर्बाध, या किसी विशिष्ट उद्देश्य के लिए उपयुक्त होगा। यह ऐप एक संगठन और शासन उपकरण है और पेशेवर लेखांकन, कानूनी, या कर सलाह का विकल्प नहीं है।

To the maximum extent permitted by law, the Company shall not be liable for any indirect, incidental, or consequential damages arising from your use of the app.

17. Intellectual property

The Simply Khata app, including its design, code, logos, and content, is the intellectual property of Olive Digital Solutions Private Limited. You are granted a limited, non-exclusive, non-transferable licence to use the app for its intended purpose. You may not copy, modify, distribute, or create derivative works from the app.

सिंपलीखाता ऐप, इसके डिज़ाइन, कोड, लोगो, और सामग्री सहित, ओलिव डिजिटल सोल्यूशंस प्राइवेट लिमिटेड की बौद्धिक संपदा है। आपको ऐप को इसके इच्छित उद्देश्य के लिए उपयोग करने का सीमित, गैर-अनन्य, गैर-हस्तांतरणीय लाइसेंस दिया जाता है। आप ऐप से कॉपी, संशोधन, वितरण, या व्युत्पन्न कार्य नहीं बना सकते।
